Expatriates Unit
Overview
EU nationals who wish to reside in Malta for more than three (3) months, and are exempt persons must register their presence in Malta and may do so, provided that they provide certain documents confirming such eligibility.

Eligibility
The applicant must prove that he is either the spouse, who is residing with the Maltese national, or the child (under the age of twenty-one (21)) of a Maltese national.
Documents required for New Application of an EU national married to Maltese national
- Applicants may apply through the Expatriates Unit Portal under Exempt basis
- If you are already in hold of a Maltese residence card, use the same registration number (the one ending in letter A)
- Copy of valid Foreign ID (front and back copy) or Passport (bio data page only)
- Copy of the bio page of the Maltese spouse’s passport;
- Copy of the Maltese spouse’s ID card;
- Copy of the Marriage Certificate (registered in Malta)
- Form E signed in wet ink signature or Advanced Electronic Signatures (AES) or Qualified Electronic Signatures (QES)
- GDPR Form signed in wet ink signature or Advanced Electronic Signatures (AES) or Qualified Electronic Signatures (QES)
- Both address on the Maltese spouse’s ID and address on the Form E must be the same address
Kindly note that applicants in hold of a valid or expired residence card shall return their residence card upon biometric appointment. If your residence card is lost, a Police Lost Report issued here in Malta needs to be presented upon appointment.
Note: Any documents provided in another language must be officially translated to English or Maltese. If the certificate translation is not completed by a Certified Translator, the certificate must be apostilled or legalized.
Documents required for Renewal of Application of an EU national married to Maltese national
- Applicants may apply through the Expatriates Unit Portal under Exempt basis
- Use the same registration number (the one ending in letter A which can be found on your back of your Maltese residence card)
- Copy of valid Foreign ID (front and back copy) or Passport (bio data page only)
- Copy of the bio page of the Maltese spouse’s passport;
- Copy of the Maltese spouse’s ID card;
- Application Form E signed in wet ink signature or Advanced Electronic Signatures (AES) or Qualified Electronic Signatures (QES)
- GDPR Form signed in wet ink signature or Advanced Electronic Signatures (AES) or Qualified Electronic Signatures (QES)
- Both address on the Maltese spouse’s ID and address on the Form E must be the same address

Documents required for Application for Children under 21
EU and Non-EU children whose EU parent is married to a Maltese national
- Applicants may apply through the Expatriates Unit Portal under Exempt basis Child of a Maltese Citizen under the age of 21
- If you are already in hold of a Maltese residence card, use the same registration number (the one ending in letter A)
- Copy of the bio page of the Maltese spouse’s passport & ID
- Dated and signed declaration from the Maltese spouse confirming s/he will take full responsibility
- Copy of the foreign parent’s travelling document and Maltese residence card if applicable
- Copy of the marriage certificate between the Maltese spouse and the applicant’s parent
- Copy of the child’s travelling document (if Non Eu full copy of travel document is required)
- Copy of the applicant’s Birth Certificate. Apostille or legalization is required, if the said certificate was issued from a Non Eu country. (One can get in touch with the relevant embassy or with the Ministry of Foreign Affair for more guidance)
- Copy of proof of custody or adoption. Apostille or legalization is required, if the said document was issued from a Non Eu country. (One can get in touch with the relevant embassy or with the Ministry of Foreign Affair for more guidance).
- Where the custody is shared, a notarized dated and signed verified letter from the other parent is required along with a copy of their travelling document . If custody is not available, dated verified letter signed by the foreign parent and notary/lawyer confirming that s/he is aware that their kid/s is/are residing in Malta with their parent is required along with a copy of the parent’s travelling document.

Timeline
The entire process takes approximately 30 working days.
