Expatriates Unit
Overview
EU nationals who have been legally residing in Malta for more than five (5) years, may be entitled to permanent residence when they have had actual and real residence in Malta for at least five (5) consecutive years.
What you’ll get
A residence document reflecting the applicant’s permanent right of residence will be issued for ten (10) years.
Eligibility
For EU nationals to be considered as having acquired the right of permanent residence, it is imperative that the EU nationals were exercising their freedom of movement rights during such (5) five-year period.
In order for family members to be considered as having acquired the right of permanent residence, the family member must have been accompanying the EU national, and resided with him in Malta as his family member, for at least five (5) years.
As per Swiss Agreement, Swiss nationals and their family members cannot apply under the Permanent Basis.
Documents required for New Application
A Union citizen who has resided legally for a continuous period of five years in Malta and his family members who are not nationals of a Member State and who have legally resided with the Eu national in Malta for a continuous period of five years, may apply for a residency card under the permanent basis which will be issued with ten (10) years expiry date.
- Applicants may apply through the Expatriates Unit Portal under Permanent basis
- Use the same registration number (the one ending in letter A which can be found on your back of your Maltese residence card)
- Eu/EEA nationals – Copy of valid Foreign ID (front and back) or Passport (bio data page only)
Non Eu nationals – Full copy of passport (including all pages compressed in one file ) - Letter addressed to the Chief Executive Officer, in which s/he should indicate the date of first arrival in Malta and the list of all periods of all absence from Malta during the last 5 years
- Applicant must submit sufficient evidence on their own name, that s/he has resided in Malta for at least six (6) months in a twelve (12) month period throughout the five (5) years.
- Application Form P signed in wet ink signature or Advanced Electronic Signatures (AES) or Qualified Electronic Signatures (QES)
- GDPR Form signed in wet ink signature or Advanced Electronic Signatures (AES) or Qualified Electronic Signatures (QES)
Note: Any document needs to be either in English or Maltese language, otherwise needs to be officially translated to English or Maltese by a verified translator
Kindly note that applicants in hold of a valid or expired residence card shall return their residence card upon biometric appointment. If your residence card is lost, a Police Lost Report issued here in Malta needs to be presented upon appointment.
Documents required for Renewal of Application
Once permanent residence is acquired, the Union citizen and his family members shall only lose such status of permanent residence through absence from Malta for a period exceeding two consecutive years.
- Applicants may apply through the Expatriates Unit Portal under Permanent basis
- Use the same registration number (the one ending in letter A which can be found on your back of your Maltese residence card)
- Eu/EEA nationals – Copy of valid Foreign ID (front and back) or Passport (bio data page only)
Non Eu nationals – Full copy of passport (including all pages compressed in one file ) - Applicant must submit one sufficient evidence for each year from when the permanent residence was acquired. Permanent process will not be affected if the applicant will not provide proof of two consecutive years. (Example applicant can provide one bank transections held each year in Malta for the past eight years)
