Identità
Identità was established in 2013 by virtue of Subsidiary Legislation 595.07 and is responsible for citizens’ identity management and the implementation of migration processes. The government agency offers a specialised public service in matters relating to e-ID cards, e-Passports, visas, residence documents, acts of civil status and public deeds. These functions were grouped under one corporate identity, which is governed by the Public Administration Act.
Identità is led by a Chief Executive Officer and has a Board of Directors, which is governed by a non-Executive Chairperson.
The Agency incorporates six previously separated government entities, which include the Identity Cards Unit, Passport Office, Public Registry, Public Registry Searches Unit, Central Visa Unit, and the Expatriates Unit. Identità has also setup a Compliance Unit which supports the Agency’s due diligence process, across the board. Furthermore, the Agency’s corporate structure consists of the following Departments: (i) Finance, (ii) IT, (iii) Human Resource Management & Administration, (iv) Legal, (v) Policy (vi), Operations, (vii) Customer Support & Response and (viii) the Marketing & PR Unit.

Applicants whose request for information was refused may submit a complaint to Identità if (i) they are not satisfied with the information provided, (ii) its format or (iii) the extension requested to revert with a decision on whether their request can be acceded to or not.
The complaint should be addressed to the Agency’s FOI Officer, who in turn shall bring this to the attention of the Chief Executive Officer.
The FOI Officer shall reply to the applicants within 10 working days from the date of receipt. Applicants will be informed that they may appeal the decision or otherwise address a complaint to the Information and Data Protection Commissioner in accordance with the Freedom of Information Act (Cap. 496 of the Laws of Malta).
The FOI Officer shall inform the applicants of the decision and should the decision not to release the information is confirmed, the officer shall explain the reasons thereof.
Applicants shall be given an explanation in writing as to why their complaint cannot be positively addressed whenever the original decision is upheld, or an extension is requested to revert with a decision on whether their request can be acceded to or not.
Applicants may also make use of the Internal Complaints Procedure to report failure to meet deadlines or to send notifications. In such cases where the request for information can be met but has not been met within the deadlines specified by the Act, the officer responsible shall waive any applicable fees for the submission of information.
