Expatriates Unit

Following the Employment Agencies Regulations (Subsidiary Legislation 452.130) which came into force on the 1st June 2024, those employers whose recruitment model falls under the definitions of applicability hence Temping/Recruitment/Outsourcing Agencies, are subject to an Employment Agency License issued by the Department for Industrial and Employment Relations (DIER) and must be in possession of such license before they submit any single permit applications on behalf of any prospective third-country employees with Identità.

 

Unlicensed agencies will NOT be permitted to submit applications with Identità as per the new regulation.

 

Licensed employers will be required to opt for applications under the context of Temping/Recruitment Agencies. More information on required documents, may be found here (link for checklists)

 

Fleet Operators

 

Fleet Operators do not fall under the scope of such regulations, however they are still required to select such contexts due to the similarity in labour market testing by the agency’s stakeholders.
